Receipt of this agreement indicates that you have read and agreed to all policies, terms and conditions as outlined below.
Policies:
Session Policies, Session Fee & Cancellations: The session fee is to reserve my time and is not considered payment towards images and therefore is non-refundable. Exceptions to this include (1) Your consumer rights as protected by law or (2) I fail to fulfill my obligations in regards to the time charged in relation to that which was stated would be provided. Fee is non-refundable if the client cancels for any reason within 48 hours of the session. Exceptions only by agreement with Tiffany Johnson Photography (aka TJP). On the day you cancel, you may nominate another person to take your appointment and have any payments made credited to their session or you may reschedule up to 30 days from original session date. No-shows forfeit the retainer.
Changes to Session: Once a session is booked and paid for the type of session cannot be changed unless agreed by TJP.
Images & Products: Photographs, images, frames, keepsakes and any other products are purchased separately unless stipulated as part of the package in writing.
Rescheduling/Postponements: In the event of poor weather, outdoor sessions may reschedule within 30 days or opt for an indoor location. If the client requests that the session be postponed for any reason, any fees paid will be non-refundable. The client will be granted a period of up to 30 days to make arrangements to complete the session.
Completing Session: If a photo session has begun, but completion must be delayed due to weather, client request, emergency or otherwise, the client will be entitled to complete the session within the next 30 days and pay only the prices listed or agreed at the time the photo session began, regardless of price increases. This remains valid for 30 days from the day of session.
Late Fees: If after 60 days of a session date passing, or when a session has begun but not completed, for any reason as outlined above, and the session fee or any other fees or costs due have not been paid when due, the client shall be liable for immediate payment of all fees/costs and other administration fees, postage, interest, and legal charges accumulated. If a client fails to pay the outstanding fees immediately a
20% administrative penalty will be imposed.
Sessions Include:
• It is the clients responsibility to carefully read the published details of each package for what it does and does not include. This can vary by package and may be exclusive of any special offers you have.
• Optional free pre-session wardrobe and location consultation. Access to wraps, gowns, robes and fabrics in my client closet as well as props during studio sessions.
• Up to 2 clothing changes.
• Length of Session: This can vary per package. Confirm with TJP the actual length of your package.
• Session time begins when photographer reaches 1st location at agreed upon time and does not stop for wardrobe changes, additional travel or punctuality of clients.
• Reasonable editing of images (such as color correction, minor touch ups, and edits at photographers discretion). Please arrive “camera ready” as extensive editing/retouching will incur additional charges. This includes editing such as, but not limited to, root touch ups, extensive facial/body retouching, backdrop changes and extensive image retouching.
• Notification sent to you when images are ready to be viewed.
• Private online gallery to present your images.
• Location: Can be onsite in my private studio or at a location determined by the client and agreed to by TJP. A location option link can also be made available to you upon request.
• Travel up to 30 miles from studio is included. Additional travel fees may apply beyond this and if they do, TJP will notify the client of estimated costs. Travel Fee is multiplied by EACH trip to the location, such as the case may be if bad weather, light or other situations such as client emergencies occur and require that the session be completed at another time, unless waived by agreement and in writing.
TJP is not responsible for the level of participation each client chooses to partake in.
Online Album Policies: Your personal gallery opens approximately 7 days from the session date. Please review the images produced and complete your order within 14 days of the images having been made available. Gallery may expire 30 days from opening. This allows an additional 2 weeks on top of the typical 14 days for you to complete your order. A fee may apply to republish a gallery after expiration for a further 30 days. After 60 days from the session date, all presented images are archived for one year.
Payment and Delivery Policies: All prices are subject to change until your fees and order have been fully paid for. Prices at time of session are honored for 30 days. Payment is due upon ordering via cash, check, credit card, Zelle, Venmo or PayPal. There is a $30 fee for returned checks. Please allow 10-14 days for delivery. Rush orders may be possible upon request. Please allow 6-8 weeks for Coffee Table Art Books as these are published by a printing press in the same manner as publishing a book. Please allow 4 weeks for jewelry, sterling silver gifts and custom totes as many of these products are handmade. Due to the custom nature of my work, all sales are final.
Updates to Agreement: Please visit http://www.tiffanyjohnsonphotography.com for detailed terms and conditions as well as updates to this agreement. All images are copyrighted by and the property of the artist, Tiffany Johnson Photography, and are protected by federal copyright laws. Copying images without permission is punishable by up to a $150,000 fine. It is against the law to copy, screen shot, scan, download, print, email, or reproduce these images in any way via any medium without written permission from TJP. Tiffany Johnson Photography retains the right to all images for promotional or competitive use without reimbursement to the client. Tiffany Johnson and associates reserve the right to refuse service to anyone who copies her work without permission. Copyright violators will be prosecuted. By receiving this agreement to hire TJP as your photographer, you are legally bound to copyright infringement laws and agree not to copy any image in any way. As an artist, it is necessary to maintain complete control over the final look of TJP client's images, and scanned images can damage a photographer's reputation by distorting and devaluing the image quality. I do not sell unedited images as it is not an accurate representation of my final work.
Exclusive Photographer: Client agrees and understands that no other party other than Tiffany Johnson Photography may take pictures of any client poses, lighting situations, or prop set-ups made by photographer during our session without permission from photographer. This includes taking pictures or videos with cell phones, cameras or any other digital device.
Complaints: I am confident you will be 100% satisfied with your order; however, if there is a problem please let me know immediately so corrective action can be taken. All presented images from your session are kept on file for one year. Tiffany Johnson Photography engages the services of the country’s premier printing house that uses only the best quality printing products and services, so you can be fully confident that should any item received have any defects, that we will work with our printer to ensure it is corrected.
Safety: TJP makes every effort to provide a safe and healthy environment during your session. Standard sanitation protocols prior to each client include but are not be limited to:

Washing hands regularly before and after photographic sessions

Sanitation of all props, chairs, benches with which a client may come into contact

Sanitation of restroom/dressing area available to clients in-studio

Sanitation of common areas, including door knobs (interior and exterior), counter tops, pens and pencils, tablets and monitors
Personal protection equipment (PPE) will be worn by photographer and staff during sessions that take place during a pandemic or natural disaster. Both photographer and staff have been fully vaccinated against Covid-19 and other typical childhood diseases. Clients not being photographed will be asked to wear PPE during this time as well. Photo session takes place at your own risk and TJP will not be held responsible for unforeseen accidents or contracted viruses that, although unlikely, may occur.
Model Release: Client hereby consents without exception, that all photographs taken during a session with Tiffany Johnson Photography may be used and reproduced in printed and online publications by Tiffany Johnson Photography for the purpose of marketing, promotions, advertising, and competitions. In the case that the subject(s) is a minor(s), client confirms by receipt of this agreement that he/she is the parent/legal guardian of the child(ren) in the session or have been given permission by the parent/legal guardian of the child(ren) in the session to accept these conditions on their behalf.
Client Signatures: By receiving this form I provide my digital signature and fully agree to all statements and policies without exception included within this Client Terms Agreement. I also confirm that I have read and understand all policies outlined above for Tiffany Johnson Photography including; Session Policies, Online Album Policies, Updates to Agreement, Payment and Delivery Policies, Client Policies, Copyright Policy, Model Release.
